We offer you with the storage container, with 240 liters capacity, a good way to store your yellow bags conveniently and cleanly. The rent for the bin is 20,99 Euro (incl. VAT) per year.

Subject of the contract

On the date of signing the contract, the Contractor shall exclusively assume the provision of all containers listed in (2) for the Customer.

1. CONTRACTUAL OBLIGATIONS

The Customer undertakes to treat the containers provided on a rental basis with care and to fill them in accordance with the regulations/agreement.

The Contractor undertakes to dispose of the waste listed in (2) on the basis of the applicable waste laws, ordinances and other provisions.

2. PAYMENTS

The prices quoted are gross prices including the statutory value-added tax applicable at the time of conclusion of the contract. Payment shall be made via SEPA basic direct debit mandate. In the event of default, interest shall be charged on the outstanding amount at a rate of 8% above the respective base interest rate in accordance with § 247 BGB.

The annual rent is collected with the January billing of each year. Storage bins placed during the year will be charged a prorated annual rent rounded up to full months. Rent will be collected after placement has occurred.

The Contractor shall be entitled to adjust the remuneration at any time if changes in the law, changes in ordinances or other sub-legal regulations, newly established or changed taxes, levies, fees, regulatory or supervisory orders or changes in case law have a significant impact on the determination of the remuneration in this contract. The adjusted remuneration shall apply pro rata from 01 of the month following the month in which the change occurred.

The customer is liable for damages that are not due to normal wear and tear, as well as in the event of theft of the containers.

Furthermore, the following additional terms and conditions apply to the provision of Lobbe storage containers for yellow bags:
The use of the storage containers for yellow bags is only permitted for private households and household-like sources of waste in accordance with Section 3 (11) of the German Packaging Act (VerpackG).

The storage container for yellow bags may only be filled with the officially available yellow bags of the collection region and must be placed at the usual staging area on the collection day - analogous to the yellow bags. Loose filling with lightweight packaging is not permitted.

Containers or yellow sacks that are incorrectly filled will be excluded from collection. Excluded containers may be made available again at the next collection after the incorrect filling has been removed.

3. ENTRY INTO FORCE, TERM AND TERMINATION

This agreement shall enter into force on the above-mentioned date and shall be concluded for an indefinite period. Termination is possible with four weeks' notice to 31.12. of each year. It must be made in writing.

If a changeover in the collection of lightweight packaging from the yellow bag to the yellow bin/valuables garbage can takes place in the contractual area within the scope of a coordination agreement between the Dual Systems and the public waste management authority, this provision agreement shall end with effect from the effective date of the system changeover. Any rental payments collected in advance will be refunded on a pro rata basis.

The agreement shall also expire if a ban on the use of storage containers for yellow bags comes into force or if the Contractor loses the collection contract for lightweight packaging in the contractual area. In such cases, the container shall be withdrawn together with any pro rata reimbursement of the collected rental costs as of the effective date of the ban or the loss of the order for the Contractor.
